Some cases become formalized through civil court proceedings that pursue to find others legally at fault through a court judgment. Some cases may be resolved outside of court through an informal settlement before a lawsuit is filed.

- Informal Settlement: Most disputes over fault for an accident are resolved through informal early settlement among those personally involved in the dispute, their insurers, and attorneys representing both sides.
