What is a personal injury case?

Personal injury cases arise when one person suffers damage from an accident or injury, and someone else is legally responsible for that damage. A personal injury case can be formal or informal. Some cases become formalized through civil court proceedings that pursue to find others legally at fault through a court judgment. Some cases may be resolved outside of court through an informal settlement before a lawsuit is filed.

  • Formal Lawsuit: A formal personal injury case starts when a private individual files a civil complaint against another person, business, corporation, or government agency alleging they acted carelessly or irresponsibly in connection with an accident or injury that caused damage.
  • Informal Settlement: Most disputes over fault for an accident are resolved through informal early settlement among those personally involved in the dispute, their insurers, and attorneys representing both sides. The different parties take part in a negotiation, followed by a written agreement where both sides waive any further action choosing instead to resolve the matter through payment of an agreeable amount of money.
